USE OF THIS WEBSITE,WWW.PERRYHOMES.COM, (THE "SITE") IS SUBJECT TO THE FOLLOWING TERMS OF USE, WHICH CONSTITUTE A LEGAL AGREEMENT BETWEEN YOU AND PERRY HOMES, LLC and ITS PAST, PRESENT, AND FUTURE PREDECESSORS, SUCCESSORS, SUBSIDIARIES, PARENTS, AFFILIATES, OFFICERS, DIRECTORS, MEMBERS, MANAGERS, EMPLOYEES, FORMER EMPLOYEES, CONTRACTORS, SUBCONTRACTORS, OWNERS, REPRESENTATIVES, ATTORNEYS, AGENTS, AND ASSIGNS ("PERRY HOMES"). DATA PRIVACY POLICY

This Data Policy describes how Perry Homes, together with its subsidiaries and affiliates (collectively, “Company,” “we,” “us,” or “our”), collects, uses discloses, and safeguards personal information in connection with our websites, mobile applications and other online and offline services.

Company maintains a website and other applications (the “Sites”) to provide our services and products to you. This Privacy Policy applies to activities Company engages in on its Sites and activities that are offline or unrelated to its Sites.

This Privacy Policy sets forth the principles that govern our treatment of personal information.   Our employees and those with whom we share personal information are required to adhere to this Privacy Policy.   This Privacy Policy applies to all personal information collected by Company relating to all customers, employees, suppliers and others that conduct business with us.

PERSONAL INFORMATION WE COLLECT AND USE

We may collect personal information from you in a variety of ways, including, but not limited to, on our Sites, through SMS text message, by email, by mail, at our physical locations and/or by telephone. Depending on how you interact with our Sites, we may have collected the following personal information from you within the past twelve (12) months:

• When you visit our Sites:  We may collect your name, location, address, telephone number, email address, demographic data, Internet Protocol address, unique personal identifier and areas of interest;
• When you give feedback or ask questions:  We may collect from you directly or from social media, your name, email address, account name, telephone number and feedback or opinions;
• When you enroll in, and use MyAccount:  We may collect your name, location, address, telephone number, email address, account number, driver’s license or state ID number or other similar identifier, demographic data and areas of interest, contract information including purchase price, and earnest money payment;
• When you make a purchase of one of our products: We may collect your name, driver’s license or state ID number or other similar identifier, Social Security number, payment card number, expiration date and CVV  from you utilizing a third-party application (e.g., Plaid.).   To learn more about Plaid and its data policy, visit https://plaid.com/legal/#consumers;  
• If you ask us to send you promotion and marketing information and special offers: We may collect your name, date of birth, email address, and phone number from you;
• When you participate in interactive sessions including chats and/or text messaging: We may collect your name, date of birth, email address, account number/name, phone number, and Internet Protocol (IP) address from you.
• Sensitive Personal Information and Affirmative Consent. Certain information we collect—such as Social Security numbers, driver’s license or state identification numbers, financial account information, and precise geolocation data—is classified as “sensitive personal information” under applicable law. We do not collect sensitive personal information through passive, implied, or pre-checked consent mechanisms. Before collecting any sensitive personal information, we obtain your affirmative, opt-in consent through an explicit consent mechanism at the point of collection, such as a clearly labeled opt-in checkbox or a signed written acknowledgment, that specifically describes the categories of sensitive personal information to be collected and the purposes for which it will be used. You may withdraw your consent at any time by contacting us using the methods in the Contact Information section below.

Automated Information.

Information regarding your use of our Sites may be collected and/or aggregated through the use of automated means.   This automatically collected information may include information such as:

• Your IP address, the type of browser and operating system used;
• Date and time you access the site and pages you visit, and if you linked from or to another website, the address of those websites;
• Email you open and links you click on within those emails;
• Your ISP or mobile carrier, and the type of handheld or mobile device that you used; and
• Your behavior while using our site, including the time you spend on portions of the site and how you interact with various aspects of the site.

Data Technologies.

Various technologies are used to automatically collect information, such as cookies, local shared objects, and web beacons (generally referred to as “Data Technologies”).   When we refer to Data Technologies, we are including all current and similar future technologies.

One or more Data Technologies may be used on the Sites.  Data Technologies may be used by us and others, on our behalf to transmit information to you or about you.

Location Information.

When you use the Sites, we may collect physical location information that is sufficiently precise to allow us to locate a specific person or device (“Location Information”). Precise geolocation data is classified as “sensitive personal information” under applicable law, including the California Privacy Rights Act (Cal. Civ. Code § 1798.140(ae)(5)), the Virginia Consumer Data Protection Act, the Colorado Privacy Act, and the Texas Data Privacy and Security Act. We will not collect Location Information unless we have first obtained your affirmative, opt-in consent through an explicit consent mechanism (such as a location-permission prompt on your device or a clearly labeled opt-in at the point of collection) that describes the categories of geolocation data to be collected and the purposes for which it will be used. We also may collect Location Information when you visit or are in the vicinity of one of our model homes, subject to the same consent requirements. We may use Location Information and provide it to third parties to provide you with content and services that are relevant to a particular location, such as advertising, search results, communities in the area, and directions, to evaluate and improve the Sites, or to provide you with content and services relevant to one or more nearby communities. Under applicable state privacy laws, including Cal. Civ. Code § 1798.121, you have the right to direct us to limit the use and disclosure of your precise geolocation data to only those uses that are necessary to perform the services or provide the goods you have requested. We retain Location Information only for as long as reasonably necessary to fulfill the specific purpose for which it was collected and in no event longer than twelve (12) months from the date of collection, unless a longer retention period is required by applicable law. Upon expiration of the applicable retention period, we will securely delete or de-identify your Location Information in accordance with our data retention policies.  

Combined Information and Information from Other Sources.

We may combine information that you provide to us with information we receive from our affiliates and other sources, as well as with other information that is automatically collected.  The combined information may include information about your use of the Sites, your use of other websites, devices and information from our affiliates and other sources.  Your personal information will be shared only in accordance with this Privacy Policy.

We do not knowingly collect, solicit, sell, share for cross-context behavioral advertising, or process for targeted advertising or profiling purposes any personal information from individuals under 16 years of age. If we learn that we have collected personal information from a child under 16 without appropriate consent, we will delete that information as soon as practicable. If you believe that a child under 16 has provided us with personal information without appropriate consent, please contact us using the Contact Information section below.  

HOW WE MAY USE YOUR INFORMATION

Your privacy is important to us.  We collect and use information we need to conduct our business, including providing you with the products and experiences you expect from Company.  When we collect and use your information, we take measures to ensure security and compliance with this Privacy Policy.   We use information we collect for any purposes consistent with our statements in this Privacy Policy, or otherwise made by us in writing at the point of collection, and not prohibited by applicable law, including, without limitation, for the following purposes:

1. For everyday business purposes, such as establishing and managing your user account, providing products and services you request and/or the products or services of others to you (such as financing), processing and collecting payments and providing customer support;
2. To communicate about, and administer your participation in, special events, programs, surveys, contests, and other offers or promotions;
3. To enable you to interact with Company through various means, such as through text, chat, email and MyAccount;
4. To evaluate and improve our business, including developing new products and services and analyzing the effectiveness of products, services, applications and websites;
5. To provide personal information to our affiliates to allow them to market or advertise their products or services to you. The categories of personal information we may share with affiliates for these purposes include identifiers (such as name, email address, and postal address), internet or other similar network activity information, and commercial information (such as records of products or services purchased or considered). This sharing may constitute a “sale” or “sharing” of personal information under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA/CPRA”) (Cal. Civ. Code § 1798.120), and a “sale” of personal data under the Texas Data Privacy and Security Act (“TDPSA”) (Tex. Bus. & Com. Code § 541.101(b)(4)). You have the right to opt out of the sale or sharing of your personal information to or with our affiliates under each applicable statute. To exercise this right, you may: (i) click the “Do Not Sell or Share My Personal Information” link on our website; (ii) email us at privacynotice@perryhomes.com (Attn: Chief Privacy Officer); (iii) call us at (844) 220-4453 (Toll-free); or (iv) enable a browser-based universal opt-out mechanism recognized by applicable law, such as the Global Privacy Control. We will process your opt-out request within the timeframes required by each applicable statute, including within 15 business days under the CCPA/CPRA and within 45 days under the TDPSA;  
6. To diagnose and address technical and service problems;
7. To perform data analyses, including market and consumer research, trend analysis, demographic analysis and financial analysis;
8. To deliver content (including advertising) correlating to your interests and browsing and usage history, both within the Sites and on other websites and applications;
9. To comply with applicable legal requirements and our policies; and
10. To contact you via telephone, text or chat.   We will obtain your consent to contact you when and, in the manner, required by law.
11. We will not collect additional categories of personal information or use personal information collected for materially different, unrelated, or incompatible purposes without providing you notice and, where required by applicable law, obtaining your consent.  

COOKIES AND SIMILAR TECHNOLOGIES

A “cookie” is a small text file that websites send to your computer or device other Internet-connected device to identify your browser or to store information or settings in the browser.  A “web beacon”, also known as an Internet tag, pixel tag or clear GIF, links web pages to web servers and their cookies and may be used to transmit information collected through cookies back to a web server.

Our Sites use cookies, web beacons, java scripts, and similar technologies to automatically collect certain information about your activity relating to your visit to our Sites.  These technologies collect your Internet Protocol (IP) address, network location, time/date stamp, referring site details, browser type, referring/exit pages, operating system, and/or clickstream data.  We use this data to analyze trends, administer our Sites, track users’ movements through our Sites, and gather demographic information about our guests as a whole.  We may receive reports based on these technologies on an aggregated basis.

Your Internet browser may let you restrict or disable certain types of cookies.   Without cookies, you may not be able to use all the options on our Sites.

BEHAVIORAL TRACKING

We use third-party analytics services on our Sites, including Google Analytics, to help us understand how visitors interact with our Sites and to improve our services. In connection with these analytics services, the following categories of personal data may be collected by or disclosed to analytics providers: Internet Protocol (IP) addresses, device identifiers (such as browser type, operating system, and screen resolution), browsing behavior and clickstream data (including pages visited, time spent on each page, and referring/exit URLs), approximate geographic location derived from IP address, and usage statistics (such as session duration and frequency of visits). This collection and disclosure may constitute “sharing” of personal information for cross-context behavioral advertising under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (Cal. Some web browsers allow you to turn on Do Not Track (“DNT”), which sends signals to websites you visit, telling those Sites that you do not want your online activities to be tracked. Where required by applicable law, we recognize and honor browser-based opt-out preference signals, including the Global Privacy Control (“GPC”), as a valid opt-out of the “sale” and “sharing” of personal information under applicable state privacy laws, including the CCPA/CPRA (Cal. Civ. Code § 1798.135(b)(1); 11 C.C.R. § 7025). Our commitment to honor GPC signals expressly applies to data shared with third-party analytics providers, including Google Analytics. When we detect a GPC signal from your browser, we will treat it as a request to opt out of the sale and sharing of your personal information, including the disclosure of analytics data to third-party providers for cross-context behavioral advertising purposes. For other browser signals, our Sites may not respond. To opt out of interest-based advertising across browsers and devices, you may also do so via the Digital Advertising Alliance or Network Advertising Initiative websites: https://youradchoices.com/ and https://thenai.org/. Opting out may not stop all advertisements, and you may need to take additional steps to opt out of targeted ad technologies in mobile apps or devices.  

Cookie Consent. Our Sites use cookies and similar tracking technologies that fall into two categories: (1) strictly necessary cookies, which are essential for the basic functionality of our Sites (such as session management, security, and authentication) and do not require your consent; and (2) analytics and advertising cookies, which are used by third-party analytics providers (including Google Analytics) to collect browsing behavior, usage statistics, and other personal data as described above. Before analytics and advertising cookies are set on your device, we will either obtain your affirmative consent through a cookie consent banner presented upon your first visit to our Sites, or provide you with a clear and conspicuous opt-out mechanism, as required by applicable law. You may manage, modify, or withdraw your cookie preferences at any time by accessing the cookie settings link available in the footer of our Sites, by adjusting your browser settings to block or delete cookies, or by enabling the Global Privacy Control signal in your browser. Please note that disabling analytics cookies may affect certain non-essential features of our Sites but will not impair core functionality. Where applicable state laws impose jurisdiction-specific consent standards (for example, affirmative opt-in consent requirements), we will comply with the more protective standard.

Sometimes we use technology to collect the information that your browser uses to auto-fill.  We use this to tell you if there is a mistake in registration or if the registration cannot be submitted.  You can stop this technology by turning it off in your browser, and you will still be able to use all the options on our Sites.

HOW WE SHARE PERSONAL INFORMATION

We may share information about you to third parties as indicated below:

Affiliates/Subsidiaries:  We may share your personal information with our affiliate companies and subsidiaries.  If we share your information, we will share only the information that is necessary, and we will take reasonable steps to ensure that third parties who receive access to your personal information take prudent steps to protect and safeguard the share personal information.

Service Providers, Suppliers, Agents, and Business Partners: We may share your information with other companies contracted to provide services to us or on our behalf (e.g., maintenance, IT support analysis, development, security, treasury management).  However, in all such cases, your personal information will only be shared for the express purposes of fulfilling or improving our products and services to you.   Our contracted third-party service providers are prohibited from using your personal information for any other purpose without your expressed consent.

Third Party Payment Processors: Any payment information that you provide to Company for our products or services will only be used to facilitate payment for such products and services.   All payment information including, but not limited to, payment card, bank account and routing numbers, is collected, used, stored and destroyed by a contracted third party.   Company does not collect or store payment information in any form, nor do we have the ability to access your payment information.  

Compliance with Legal Obligations:  We may disclose certain information to auditors, government authorities, law enforcement, regulatory agencies, our legal counsel, third-party litigants and their counsel, other relevant third parties, such as Internet service providers, or other authorized individuals in order to comply with laws that apply to us, or other legal obligations such as contractual requirements.   Your personal information may occur when disclosure is necessary or advisable, in our sole discretion, to conduct an investigation, respond to third party or law enforcement subpoena or court order, bring legal action; prevent harm to others or pursue other relief when you or a third party are or may be: (a) violating our terms of service; (b) causing injury or other harm to, or otherwise violating our property or other legal rights or those of other third parties; or (c) violating federal, state, local , or other applicable law.   To the extent we are legally permitted to do so, we will take reasonable steps to notify you in the event that we are required to provide your personal information to third parties in connection with a subpoena.

Changes in Business Structure/Ownership:  We may disclose or transfer your personal information to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of Company’s business, assets, or ownership interest (including any bankruptcy or similar proceedings).

De-identified or Aggregated Information:  We may use personal information to create de-identified or aggregated data that cannot reasonably be used to identify you. We maintain and use de-identified data without attempting to re-identify it, except to evaluate whether our de-identification processes are adequate. We may use and share de-identified or aggregated data for any lawful purpose.  

Information We Disclose for a Business Purpose:  In addition to the purposes described in this policy, we may use personal information listed below for business purposes.

• To provide you with products and services, including customer service, processing orders or transactions, verifying consumer information, processing payments, we use the following categories of information: identifiers, personal information subject to Cal. Civ. Code § 1798.80(e) and the Texas Data Privacy and Security Act, protected classifications, and online activity.
• To improve our website, including responding to inquiries and improving functionality, we use the following categories of information: identifiers and online activity.
• To comply with your requests, including sending your information to third parties if you ask us to do so: identifiers, personal information subject to Cal. Civ. Code § 1798.80(e) and the Texas Data Privacy and Security Act, protected classifications, and online activity.

Sharing excludes text messaging originator opt‑in data and consent; this information will not be shared with any third parties.

HOW WE PROTECT YOUR PERSONAL INFORMATION\ We maintain reasonable administrative, technical, and physical safeguards designed to protect your personal information from unauthorized access, disclosure, alteration, and destruction. These measures include, but are not limited to: limiting access to personal information to authorized employees who require such access to perform their job functions; implementing encryption for sensitive personal information both in transit and at rest; conducting periodic security assessments and audits; and maintaining incident response procedures. We also require our service providers to implement appropriate security measures to protect the personal information we share with them.  

While we cannot guarantee that loss, misuse, or alteration will never occur, we use reasonable efforts to prevent it.  Please keep in mind that no method of storage or transmission over the Internet is completely secure, so your use of our services and provision of information to us is at your own risk.

Our Sites may contain links to other Sites on the Internet that are owned and operated by third parties.   The information practices of those websites linked to our Sites are not covered by this Privacy Notice.  We are not responsible for the privacy policies of other websites to which our Sites link.

RETENTION OF PERSONAL INFORMATION\ We retain your personal information only for as long as reasonably necessary to fulfill the purposes for which we collected it, as detailed in this Privacy Policy, including to satisfy any legal, accounting, or reporting requirements. When determining the appropriate retention period, we consider the amount, nature, and sensitivity of the personal information; the potential risk of harm from unauthorized use or disclosure; the purposes for which we process your personal information and whether we can achieve those purposes through other means; and the applicable legal requirements. Upon expiration of the applicable retention period, we will securely delete, anonymize, or de-identify your personal information in accordance with applicable law and our data retention policies.  

ADDITIONAL U.S. STATE PRIVACY NOTICES (UPDATED FOR 2025)\ Effective in 2025, several additional U.S. state privacy laws are in force, including in Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Tennessee (effective July 1, 2025), Minnesota (effective July 31, 2025), and Maryland (effective October 1, 2025). Consistent with our nationwide approach, we extend comparable rights and disclosures to U.S. consumers, and we will honor any state-specific rights as required by applicable law.

• Universal opt-out signals: Where required, we honor browser-based opt-out preference signals (such as Global Privacy Control) to affect your opt-out of “sales,” “sharing,” and/or targeted advertising. • Sensitive data and data minimization: Where required (including, for example, under Maryland and Minnesota law), we limit the collection and processing of personal data to what is reasonably necessary and proportionate for the disclosed purposes of providing requested products or services. We process sensitive personal data only with your consent or as otherwise permitted by applicable law and do not sell sensitive personal data where prohibited. Sensitive data may include Social Security numbers, government-issued identification numbers, financial account information, precise geolocation data, racial or ethnic origin, religious beliefs, health information, sexual orientation, citizenship or immigration status, and genetic or biometric data.  
• Minors’ data: We do not knowingly collect personal information from children under 13 years of age. Where required (including, for example, under New Jersey, Delaware, and Maryland law), if we have actual knowledge that a consumer is between 13 and 17 years of age, we will not process their personal data for targeted advertising, profiling in furtherance of decisions that produce legal or similarly significant effects, or “sale” without obtaining affirmative authorization (opt-in consent from the minor or the minor’s parent/guardian, as applicable). Where required under California law, we do not sell or share the personal information of consumers we know to be under 16 years of age without affirmative authorization.  
• Transparency about third parties: Residents of certain states (including Delaware, Minnesota, and Maryland) may request information about the categories and, where required, the specific third parties to whom we disclosed their personal data. Use the Contact Information section below to submit such a request.
• Financial incentives: We may offer financial incentives, including discounts, coupons, or other benefits, in exchange for the collection, retention, or sale of your personal information. When we offer a financial incentive, we will provide you with notice of the material terms of the incentive program and obtain your opt-in consent before enrolling you. You may withdraw from a financial incentive program at any time by following the instructions in the program terms or by contacting us. The value of your data to us is reasonably related to the value of the discount or other benefit offered.  
• Appeals: If we deny your privacy request in whole or in part, you may appeal our decision by replying to our response email or by using the Contact Information below with the subject line “Privacy Request Appeal.” We will acknowledge receipt of your appeal and inform you in writing of any action taken or not taken in response to the appeal within the timeframe required by applicable law (typically 45-60 days), including an explanation of the reasons for our decision. If we deny your appeal, we will provide you with information on how to contact your state attorney general or other applicable regulatory authority to submit a complaint.  
• Your Opt-out Rights link: Where required (for example, in Minnesota), we provide a clearly labeled link such as “Your Opt-out Rights” or “Your Privacy Rights” to submit opt-out requests.
• Point of contact: Our Chief Privacy Officer (or designee) is responsible for our compliance with applicable state privacy laws and can be reached using the Contact Information below.
• Automated decision-making and profiling: We may use automated decision-making technologies, including profiling, to deliver personalized content, advertising, and recommendations. Where required by applicable law, you have the right to opt out of profiling in furtherance of decisions that produce legal or similarly significant effects concerning you. TEXAS PRIVACY NOTICE

Your Rights and Choices\ The Texas Data Privacy and Security Act (“TDPSA”) provides residents of the State of Texas the following rights regarding their personal information: (1) the right to confirm whether we are processing your personal data and to access such data; (2) the right to correct inaccuracies in your personal data; (3) the right to delete your personal data; (4) the right to obtain a portable copy of your personal data in a readily usable format; and (5) the right to opt out of (a) the sale of your personal data, (b) targeted advertising, and (c) profiling in furtherance of decisions that produce legal or similarly significant effects concerning you. We will respond to your verified request within 45 days, or within 90 days if reasonably necessary with notice to you explaining the reason for the extension.  

Within this Privacy Policy, we are providing you with notice of our privacy practices in this including what personal information is collected, the source of the personal information, and the purposes of use, as well as whether Company discloses that personal information and if so, the categories of third parties to whom it is disclosed and the categories of personal information disclosed to those third parties.   We also herein notify you if we sell your personal information.   If you need to contact us or have questions, please do so as set out in the Contact Us section below.

Sale of Personal Data\ We may disclose your personal information to third parties in ways that may be considered a “sale” under the TDPSA. We do not sell sensitive personal data.  

CALIFORNIA PRIVACY NOTICE

Your Rights and Choices\ Under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA/CPRA”), California residents have the following rights regarding their personal information, which we will accommodate where your requests meet legal and regulatory requirements and do not risk making our other data less secure or changing our other data. You may also designate an authorized agent to make a request on your behalf.  

Access, Erase: You may have the right to know what information is being collected about you, to access your personal information, to receive a copy of your information, and to know whether your personal information is disclosed, and to whom.   You also may request that we erase your information.   If you have questions about your information or want to ask us to erase your information, please contact us using the methods in the Contact Us section below.

Data Portability: If you would like to request that we provide a copy of your information to you, please contact us using the methods in the Contact Us section below.

Non-Discrimination: You have the right not to receive discriminatory treatment by the Company because you exercise your privacy rights.   If you have any questions, please contact us using the methods in the Contact Us section below.

Right to Limit Use of Sensitive Personal Information: Under Cal. Civ. Code § 1798.121, you have the right to direct Perry Homes to limit the use and disclosure of your sensitive personal information to only those uses that are necessary to perform the services or provide the goods you have requested, or as otherwise permitted by law. The categories of sensitive personal information subject to this right include: Social Security numbers; driver’s license or state identification numbers; financial account information, including payment card data; precise geolocation data; racial or ethnic origin; religious beliefs; health information; and other categories specified under Cal. Civ. Code § 1798.140(ae).
